These Terms of Service apply when a homeowner, property owner, prospective client or project contact uses the Architectural Partner Network homeowner project support service.

Architectural Partner Network may also be referred to in these terms as APN, we, us or our.

By submitting a project support form, requesting introductions, ticking the relevant consent boxes or using our homeowner support service, you agree to these Terms of Service.

These terms should be read together with our Privacy Policy and Cookie Policy.

1. About Architectural Partner Network

 

Architectural Partner Network is a curated project support and introduction platform connected with residential design, planning and pre-build project guidance.

APN helps homeowners and property owners connect with relevant independent professionals, contractors, consultants, suppliers and service providers who may be able to assist with different parts of a residential project.

This may include, for example:

  • building contractors;

  • structural engineers;

  • party wall surveyors;

  • building control providers;

  • drainage specialists;

  • glazing and door suppliers;

  • kitchen, bathroom and interior specialists;

  • project managers;

  • trade contractors;

  • surveyors;

  • finance, product, supplier or home improvement partners.

The exact services available will depend on the nature, location and stage of your project.

2. APN is an introduction service

 

APN is not the contractor, consultant, supplier, lender, insurer, designer, surveyor, project manager or professional adviser unless this is expressly agreed in writing under a separate appointment.

Our role is usually limited to helping identify potential third-party providers who may be relevant to your project and, where you have given permission, introducing your details to those providers.

Any contract for services, supply, advice, works, products, finance or professional support will be directly between you and the relevant third-party provider.

APN is not a party to that contract unless this has been expressly agreed in writing.

3. No guarantee of appointment, quotation or outcome

 

APN may introduce you to one or more possible providers. However, we do not guarantee that:

  • a provider will be available;

  • a provider will respond;

  • a provider will offer a quotation;

  • a provider will accept your project;

  • you will receive a particular price;

  • you will obtain cheaper quotes;

  • a provider will be suitable for your specific circumstances;

  • your project will receive planning permission, Building Regulations approval, listed building consent, landlord consent, freeholder consent, funding approval or any other approval;

  • any works will be completed to a particular timescale, budget or standard.

Any examples, guidance, comments or general information provided through APN are intended to assist with project direction only and should not be treated as a guarantee.

4. Independent providers

 

Providers introduced through APN are independent businesses or professionals.

They are not employees, agents, partners or representatives of APN unless expressly stated otherwise.

You are responsible for making your own decision about whether to instruct any provider introduced through APN.

Before appointing any provider, you should satisfy yourself as to their suitability, experience, qualifications, insurance, availability, quotation, terms, professional status and ability to carry out the required services.

Where appropriate, you should ask for:

  • written quotations;

  • written terms of business;

  • evidence of insurance;

  • examples of previous work;

  • references;

  • professional memberships or registrations;

  • confirmation of who will be responsible for design, specification, supervision, Building Regulations compliance and site safety.

5. Provider checks and APN verification

 

APN may carry out reasonable checks before allowing certain providers to join or remain within the network. This may include requesting references, business information, insurance details, professional details, project experience or other credibility checks.

However, APN verification does not mean that APN guarantees a provider’s work, advice, conduct, financial standing, insurance position, availability or suitability for your project.

Any APN Verified Partner badge, profile or membership status is a network credibility indicator only. It is not a warranty, guarantee, insurance policy or professional endorsement for a specific project.

6. Your responsibility for project decisions

 

You remain responsible for all decisions relating to your property and project.

This includes decisions about:

  • whether to proceed with the project;

  • which providers to contact or appoint;

  • which quotation to accept;

  • whether a design, product, specification or construction method is suitable;

  • whether the project requires planning permission, Building Regulations approval or other consents;

  • whether to obtain legal, financial, structural, surveying or other professional advice;

  • whether to proceed with any building works, purchases, finance arrangement or professional appointment.

APN may provide general project support, but you should not rely on APN as your sole source of advice for legal, financial, technical, planning, construction, tax, insurance or safety matters.

7. Planning, Building Regulations and statutory approvals

 

Residential projects may require planning permission, a Certificate of Lawful Development, Building Regulations approval, structural design, party wall procedures, listed building consent, conservation area consent, highways approval, drainage approval, Thames Water or sewer consent, landlord consent, freeholder consent, management company consent, mortgage lender consent or other permissions.

APN does not guarantee that any approval will be obtained.

You should ensure that appropriate professional advice is obtained before works start.

Any drawings marked as preliminary, planning, concept, feasibility or design-stage drawings should not be used for construction unless they have been expressly prepared and approved for that purpose.

8. Quotations, prices and payments

 

Any quotations, prices, estimates, payment terms or fee proposals provided by third-party providers are the responsibility of those providers.

APN is not responsible for setting, approving, checking, negotiating or enforcing third-party prices unless this has been expressly agreed in writing.

You should check whether any quotation includes or excludes VAT, design work, professional fees, Building Control fees, planning application fees, structural calculations, party wall costs, product costs, delivery, disposal, surveys, access equipment, contingency sums, provisional sums, variations or other additional charges.

You should make sure that any agreed price and scope are recorded in writing before instructing work.

9. Affiliate links, referral arrangements and commercial relationships

 

APN may receive subscription fees, membership fees, referral fees, affiliate commissions, advertising fees or other commercial benefits from providers, suppliers, platforms or third-party services.

This does not increase the price you pay unless expressly stated by the relevant provider or supplier.

APN may recommend, list or introduce providers or services because they appear relevant to your project, because they are members of the APN network, because they operate within your area, because they provide the category of service requested, or because there is an affiliate or commercial relationship in place.

Where required, APN will make appropriate disclosures in relation to affiliate links or paid commercial relationships.

10. No responsibility for third-party websites or services

 

Our website or project support communications may include links to third-party websites, partner pages, supplier websites, payment platforms, booking systems, affiliate links or external resources.

APN is not responsible for the content, accuracy, availability, pricing, privacy practices, terms, products or services of third-party websites or external providers.

You should read the relevant third-party terms and privacy notices before using their services or entering into any contract.

11. Sharing your details with providers

 

If you request introductions through APN, we may ask for your permission to share your project details with selected providers.

The information shared may include your name, contact details, project address, project description, approximate budget, project stage, drawings, photographs, planning information, property information or other information you choose to provide.

We will only share your details with providers where we have a lawful basis to do so and where this is relevant to the support or introductions you have requested.

You should only provide information that is accurate and that you are entitled to share.

12. Consent to contact

 

By submitting a project support form or requesting APN introductions, you agree that APN may contact you about your project.

Where you have given consent, selected providers may also contact you about the services you requested.

You can withdraw consent or ask us not to make further introductions by contacting APN.

Withdrawing consent may affect our ability to provide project support or make introductions.

13. Accuracy of information you provide

 

You are responsible for making sure the information you provide to APN is accurate, complete and not misleading.

This includes property details, project details, ownership details, planning history, site constraints, budget, timescales, contact information and any drawings, documents or photographs supplied.

APN and third-party providers may rely on the information you provide when assessing whether they can assist.

APN is not responsible for problems caused by inaccurate, incomplete or misleading information provided by you or by a third party.

14. Documents, drawings and project information

 

If you upload or send drawings, photographs, reports, planning documents or other project information, you confirm that you have the right to share that information with APN.

You also give APN permission to review, store and share relevant information with selected providers for the purpose of helping with your project support request.

APN may decline to share documents where we consider them unsuitable, incomplete, unclear, commercially sensitive, unsafe or inappropriate.

15. No emergency service

 

APN is not an emergency service.

You should not use APN for urgent structural danger, gas leaks, electrical danger, flooding, fire safety emergencies, unsafe works, collapse risk, criminal matters or immediate health and safety risks.

In an emergency, you should contact the appropriate emergency services, utility provider, insurer, local authority or qualified emergency contractor.

16. Complaints about providers

 

If you have a complaint about a third-party provider, you should raise it directly with that provider in accordance with their own complaints process and contract terms.

APN may, at its discretion, review feedback about providers and may decide whether a provider should remain part of the APN network.

However, APN is not responsible for resolving contractual disputes between you and a third-party provider.

APN does not act as an adjudicator, arbitrator, expert witness, debt collector, solicitor or complaints body.

17. Limitation of liability

 

Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to the above, APN will not be liable for:

  • the acts or omissions of third-party providers;

  • defective, delayed, incomplete or unsuitable work by third-party providers;

  • inaccurate quotations or advice provided by third-party providers;

  • any contract entered into between you and a third-party provider;

  • loss of profit, loss of opportunity, loss of business, loss of savings, loss of goodwill or indirect losses;

  • planning refusal, Building Control rejection or other statutory refusal;

  • delays caused by providers, councils, inspectors, suppliers, contractors, weather, site conditions or third parties;

  • decisions you make based on general project support information;

  • any loss arising from inaccurate or incomplete information supplied by you.

APN’s total liability in connection with the homeowner project support service shall be limited to the amount paid by you directly to APN for that specific service, if any.

If no fee has been paid by you directly to APN for the homeowner project support service, APN’s liability shall be limited to £100, to the maximum extent permitted by law.

18. Free homeowner support

 

Where APN provides homeowner project support or introductions free of charge, this does not create a professional appointment, consultancy appointment, construction contract, agency relationship or advisory duty beyond the limited introduction service described in these terms.

Free support may be withdrawn, amended or declined at any time.

APN is not obliged to provide introductions, review project documents, chase providers or continue support indefinitely.

19. Paid homeowner services

 

If APN offers any paid homeowner support services, the scope, fee and deliverables will be set out separately before the service starts.

Paid services may include, for example, project review, quotation comparison support, feasibility review, partner matching support, project route guidance or other defined services.

Any paid service will be governed by these terms together with any specific written proposal, order page, engagement letter or checkout terms provided at the time.

20. Cancellation rights

 

If you purchase a paid service from APN as a consumer online, by phone or away from business premises, you may have cancellation rights under consumer protection law.

Where cancellation rights apply, we will provide relevant information before or at the time of purchase.

If you ask us to start providing a paid service during any cancellation period, you may still have cancellation rights, but you may be required to pay for work carried out before cancellation.

This section does not apply to separate contracts you enter into directly with third-party providers. Their own cancellation terms will apply.

21. Changes to the APN homeowner support service

 

APN may update, change, suspend or withdraw the homeowner project support service at any time.

We may also change the providers, categories, territories, forms, partner availability, referral process or support options available through APN.

We will try to ensure that information on our website is accurate and up to date, but we do not guarantee that all content will always be complete, current or error-free.

22. Acceptable use

 

You agree not to misuse the APN website, forms or project support service.

You must not:

  • provide false, misleading or abusive information;

  • submit enquiries for properties you have no legitimate connection with;

  • upload unlawful, harmful or infringing material;

  • use APN to harass providers or third parties;

  • attempt to interfere with the website or its security;

  • copy, scrape or misuse APN content, provider lists or partner information.

APN may refuse service, remove access or decline introductions where we consider the service is being misused.

23. Intellectual property

 

All APN website content, branding, text, graphics, page layouts, partner category content, badges, logos and other materials are owned by APN or used under licence.

You may view and use website content for your own personal project purposes only.

You must not copy, reproduce, publish, distribute or commercially exploit APN content without written permission.

24. Privacy and data protection

 

APN will process personal information in accordance with its Privacy Policy.

Where APN shares your information with selected providers, those providers may become independent data controllers for the information they receive and will be responsible for their own privacy practices.

You should read the privacy information provided by any provider you choose to contact or instruct.

25. Governing law

 

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, except where consumer protection law gives you the right to bring a claim in another part of the United Kingdom.
